Welcome to Boldbooty. These Terms of Service govern your use of boldbooty.com and any purchases you make from Bold Booty Inc. ("Boldbooty," "we," "us," or "our"). By using our site or placing an order, you agree to these Terms.
If you do not agree to these Terms, do not use our site or purchase our products.
Who can use our site
You must be at least 18 years old, or the age of majority in your jurisdiction if greater, to purchase from Boldbooty. By placing an order, you represent that you are of legal age and have the authority to enter into this agreement.
Products
We do our best to accurately describe and display our products, including colors, sizes, and materials. Actual colors may vary based on your screen settings, and product measurements may vary by 0.5–1 inch due to manufacturing tolerances common to activewear.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse or cancel any order at our discretion, including orders that appear to violate these Terms or be placed by resellers.
Pricing and payment
All prices are in US dollars and do not include shipping or applicable taxes, which are calculated at checkout. Prices are subject to change without notice, but changes will not affect orders already placed.
We accept major credit and debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, and Klarna. Payment must be received in full before your order ships.
If a product is listed at an incorrect price due to a pricing error, we reserve the right to cancel the order or contact you before shipping to confirm you'd like to proceed at the corrected price.
Orders and shipping
Once you place an order, you'll receive an email confirmation. Order acceptance and the formation of a contract of sale between you and Boldbooty occur when we ship the products to you, not when you place the order.
Shipping times and costs are outlined in our Shipping Policy. Boldbooty is not responsible for delays caused by carriers, weather, customs, or other events outside our control.
Title and risk of loss pass to you when your order is delivered to the shipping address you provided.
Returns and exchanges
Our return and exchange policy is outlined in our Refund Policy. Please read it before making a purchase.
Intellectual property
The site and all content on it — including the Boldbooty name, logo, product designs, photography, videos, text, and graphics — are owned by Bold Booty Inc. or licensed to us, and are protected by US and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any content on our site without our prior written permission. You may share our content on social media in a manner consistent with the platform's terms of service and while properly attributing Boldbooty.
User content
If you submit photos, videos, reviews, comments, or other content to us (including by tagging us on social media, submitting reviews, or emailing us), you grant Bold Booty Inc. a worldwide, royalty-free, non-exclusive, perpetual, and transferable license to use, reproduce, modify, publish, distribute, and display that content in connection with our business, including for marketing and promotional purposes, without additional compensation.
You represent that any content you submit is your own original work, does not infringe anyone's rights, and does not contain unlawful, defamatory, obscene, or offensive material.
SMS Marketing
In addition, you agree to our Messaging Terms (https://terms.pscr.pt/legal/shop/0831pr-iu/terms_of_service) and Messaging Privacy Policy (https://terms.pscr.pt/legal/shop/0831pr-iu/privacy_policy).
Prohibited uses
You may not use our site to:
- Violate any law or regulation
- Impersonate anyone or misrepresent your affiliation
- Interfere with or disrupt the site or servers
- Attempt to gain unauthorized access to any part of the site
- Use bots, scrapers, or automated tools without our permission
- Purchase products for the purpose of resale without our written consent
- Engage in fraudulent activity, including credit card fraud or return fraud
We reserve the right to refuse service, terminate accounts, cancel orders, and take legal action against anyone who violates these Terms.
Disclaimers
Our products are sold "as is" and "as available" without warranties of any kind, express or implied, except as required by applicable law. Boldbooty makes no warranty that:
- The site will be uninterrupted, error-free, or secure
- The results of using our products will meet your expectations
- Any errors on the site will be corrected
Limitation of liability
To the maximum extent permitted by law, Bold Booty Inc. and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or our products, including lost profits, lost data, or personal injury, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or your use of the site or our products is limited to the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Bold Booty Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these Terms, or your violation of any rights of a third party.
Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
Informal resolution first: Before filing any claim, you agree to first contact us at hello@boldbooty.com to attempt to resolve the dispute informally. We will do the same.
Arbitration: Any dispute that cannot be resolved informally within 60 days shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English in Los Angeles County, California, or by video conference at the arbitrator's discretion.
Class action waiver: You and Boldbooty agree that any dispute will be resolved on an individual basis, and neither party may bring a claim as a plaintiff or class member in any class or representative action.
Small claims exception: Either party may bring an individual claim in small claims court if the claim qualifies.
Right to opt out: You may opt out of the arbitration agreement by emailing hello@boldbooty.com within 30 days of first accepting these Terms, with your name and a statement that you wish to opt out of arbitration.
Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our site. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Bold Booty Inc.
